RFE, NOID, & NOIT Responses

We provide strategic, deadline-driven responses to Requests for Evidence (RFEs), Notices of Intent to Deny (NOIDs), and Notices of Intent to Terminate (NOITs). Our team conducts a thorough review of the record, identifies weaknesses, and crafts targeted legal and evidentiary responses that directly address agency concerns. Leveraging decades of high-stakes advocacy experience , we focus on clarity, credibility, and persuasion to protect your petition and improve the likelihood of approval.

Below is a sample response to an RFE issued by USCIS on an investor’s I-526 petition. This sample is loosely based on an actual case. The RFE had raised issues related to the project and our response addressed each, marshaling the additional evidence submitted in further support of the petition. We work with investors and project representatives to identify all issues raised in the RFE, we help formulate a strategy for responding to the issues raised, and we work with our clients to assemble the evidence needed to address each issue. In cases in which USCIS overreaches, we include legal argument on why the petition should be approved without certain requested evidence. We also provide mandamus and other litigation support when USCIS fails to follow the law.
